Buyer’s Premium: 10% on all purchases


1. Buyer’s Premium

A 10% Buyer’s Premium applies to all successful bids and will be added to the hammer price.

2. Registration & Bidding

  • To bid, you must register at our online platform and provide your full name, address, phone number, email address, and a valid credit card.

  • By registering, you authorize Wooley Auctioneers to charge your credit card for the purchase amount plus Buyer’s Premium and any applicable fees.

  • All bids placed constitute a binding contract. If you are the high bidder, you commit to pay in full and perform all obligations described herein.

3. Payment

  • Accepted payment methods: Visa, MasterCard, American Express, Discover, cash, cashier’s check, or wire transfer.

  • Credit card payments are subject to a surcharge of 3.5%.

  • For purchases exceeding $1,500, credit card payment will not be accepted; payment must be made by cash, cashier’s check, or wire transfer.

  • Personal checks are not accepted.

  • Payment must be completed at the time of removal/pick-up of purchased items. If you intend to have a third-party pick up on your behalf, you must contact Auctioneer Brad Wooley (501-940-3979) before removal to arrange proper payment.

4. Removal / Load-Out

  • Items must be removed on Thursday, November 6 and Friday, November 7, 2025 from 9:00 AM to 5:00 PM (CT). No exceptions.

  • Buyers are responsible for bringing the necessary tools, equipment, manpower, and transportation to safely remove and load purchased items.

  • All items are sold and removed AS-IS, WHERE-IS; nothing will be stored or retained by the seller beyond the stated removal period.

5. Shipping

  • Large or heavy items may require professional rigging/shipping. While Wooley Auctioneers may assist with contact information, buyers are responsible for all shipping arrangements and costs.

  • If you intend to have items shipped, contact shipping providers immediately after the auction closes to request a quote.

6. Condition of Items / Inspection

  • All items are offered for sale “AS IS, WHERE IS.” The auctioneer and seller expressly disclaim any warranties or guarantees, expressed or implied, including fitness for a particular purpose or merchantability.

  • Buyers are encouraged to inspect items during the designated preview period (Tuesday, November 4, 2025 from 11:00 AM to 1:00 PM) to determine condition, age, usage, and compatibility.

  • While descriptions and photographs are believed to be accurate, neither seller nor auctioneer is responsible for any errors, omissions, or misstatements.

7. Bidding & Internet Auction Platform

  • This auction is online only. The auctioneer uses an internet bidding platform, but does not guarantee uninterrupted or error-free operation.

  • The auctioneer is not liable for any missed bids or system failures.

  • A “soft close” may be in effect: if a bid is placed within the last minute of the scheduled closing time, the lot may be automatically extended (commonly by one minute) to allow further bidding and prevent “sniping.”

  • The auctioneer reserves the right, at any time, to withdraw or re-catalog items, or modify the bidding schedule, for any reason.

8. Winning Bidder Responsibilities

  • The winning bidder for each lot must pay the full invoice (hammer price + Buyer’s Premium + applicable surcharges) and complete pickup/removal within the stated removal timeframe.

  • Failure to perform (payment and removal) by the removal deadline will result in forfeiture of the lot, the winning bidder remaining liable for all payments owed, and no refunds will be issued.

9. Age & Legal Compliance

  • Bidders must be at least 18 years of age (or the age of majority in their jurisdiction). By bidding, the bidder confirms they meet this requirement.

  • Purchases may be subject to additional local, state or federal regulations (e.g., signage removal, hazardous materials, rigging). Buyers are responsible for compliance and any associated costs.

10. Sales Tax & Licenses

  • Wherever applicable, Arkansas state sales tax and/or local tax will be added to the purchaser’s invoice unless the buyer provides a valid resale certificate prior to bidding.

  • It is the buyer’s responsibility to understand and adhere to all applicable tax obligations.

11. Announcements & Addenda

  • Announcements made by the auctioneer (either written or verbal) PRIOR to the close of bidding take precedence over the printed or posted terms and catalog information.

  • It is the bidder’s responsibility to check for updates, addenda, or changes to terms and lots prior to bidding.

12. Jurisdiction & Legal Venue

  • This contract shall be governed by the laws of the State of Arkansas.

  • Any dispute arising under or in connection with the auction must be brought in a court of competent jurisdiction in Pulaski County, Arkansas.

13. Refusal & Buyer Default

  • The auctioneer and seller reserve the right to refuse service or bidding privileges to any person for any reason.

  • In the event of buyer default (non-payment or failure to remove), the auctioneer may hold the buyer responsible for any losses, costs or fees incurred, and may resell the item(s) at auction or by other means.

14. Severability

  • If any term or condition herein is determined to be invalid or unenforceable, it shall not affect or invalidate any other term of this agreement, which shall remain in full force and effect.

15. Acceptance of Terms

  • By registering to bid and/or placing a bid in this auction, the bidder acknowledges that they have read, understand and agree to abide by all the terms and conditions set forth herein.
