Buyer’s Premium: 10% on all purchases
1. Buyer’s Premium
A 10% Buyer’s Premium will be added to the final bid price of every lot, forming the total purchase amount owed by the buyer.
2. Registration & Bidding
All bidders must register through the online bidding platform and provide complete and accurate information including name, address, phone number, email, and a valid credit card.
By registering, bidders authorize Wooley Auctioneers to charge their credit card for purchases and applicable fees where permitted.
All bids are binding. If you are the high bidder, you are contractually obligated to pay for your purchases.
3. Payment
Accepted payment methods include:
- Visa, MasterCard, American Express, Discover
- Cash
- Cashier’s Check
- Wire Transfer
- A 3.5% surcharge applies to all credit card payments
- Credit cards are accepted only for invoices under $1,500
- Invoices over $1,500 must be paid by cash, cashier’s check, or wire transfer
- No personal checks accepted
Payment must be completed prior to removal.
If a third party is picking up your items, you must contact Auctioneer Brad Wooley at 501-940-3979 prior to removal to arrange payment.
4. Removal / Load-Out
All items must be removed during the scheduled times listed above.
No exceptions. No storage available.
Buyers are solely responsible for providing all tools, equipment, labor, rigging, and transportation necessary to safely remove purchased items.
Certain items require professional removal, including walk-in coolers and vent hood systems.
All items are sold AS-IS, WHERE-IS, and no items will be stored or held beyond the removal period.
Items remaining after the deadline will be considered abandoned, and no refunds will be issued.
5. Refrigeration Systems (Walk-In Coolers/Freezers)
The auction company will pump down and reclaim refrigerant into the condenser units prior to load-out, allowing lines to be safely cut without releasing refrigerant.
Buyer is responsible for all remaining disconnection and removal, including:
- Electrical disconnect
- Mechanical separation
- Removal of evaporators, condensers, and related components
- Removal of any roof-mounted equipment
Buyer may elect to abandon rooftop condensing units. If removal is performed, it must be completed by a licensed and insured HVAC professional.
All work must comply with applicable laws and regulations.

6. Vent Hood Systems
Vent hoods may be connected to roof-mounted exhaust fans, ductwork, make-up air systems, and fire suppression systems.
Buyer is responsible for:
- Disconnecting electrical and mechanical connections
- Properly disabling fire suppression systems in accordance with code
- Removal of ductwork and roof-mounted equipment
- Sealing and weatherproofing roof penetrations
All work must be performed by licensed and insured professionals where required.
7. Removal Liability & Site Responsibility
- Buyer assumes all liability for damage to building, roof, utilities, or surrounding property
- Proof of insurance may be required prior to removal
- No cutting, torching, or demolition that damages property is allowed without approval
- Any damage caused must be repaired at Buyer’s expense
Failure to comply may result in:
- Denial of removal access
- Forfeiture of items without refund
- Financial responsibility for damages
8. Shipping
Wooley Auctioneers does not provide shipping.
Buyers are responsible for arranging all freight, rigging, and transportation. Obtain quotes and make arrangements prior to bidding.
9. Condition of Items / Inspection
All items are sold AS-IS, WHERE-IS, with no warranties or guarantees of any kind.
Preview is available for inspection. Bidders are responsible for determining condition, completeness, and suitability prior to bidding.
Descriptions and photos are believed accurate but not guaranteed.
10. Bidding & Internet Platform
This is an online-only auction. Wooley Auctioneers does not guarantee uninterrupted service or bid transmission.
This auction features a soft close—bids placed in the final minute will extend the lot.
Auctioneer reserves the right to:
- Add or remove lots
- Re-catalog items
- Modify closing times
- Resolve disputes at their discretion
11. Winning Bidder Responsibilities
Winning bidders agree to:
- Pay all invoices in full
- Remove all items within scheduled times
Failure to comply may result in forfeiture and liability for damages and costs.
12. Age & Legal Compliance
Bidders must be at least 18 years old.
Buyers are responsible for complying with all local, state, and federal regulations related to removal, handling, and disposal of items.
13. Sales Tax
Applicable Arkansas sales tax will be collected unless a valid resale certificate is provided prior to bidding.
14. Announcements & Addenda
Any announcements or updates made prior to auction close take precedence over printed materials.
15. Jurisdiction & Venue
This auction is governed by the laws of the State of Arkansas.
Any disputes shall be handled in Pulaski County, Arkansas.
16. Refusal of Service & Buyer Default
Auctioneer reserves the right to refuse service to anyone.
In the event of default, buyer is liable for all losses, damages, and costs.
17. Severability
If any portion of these terms is deemed unenforceable, the remaining terms remain in effect.
