Load-Out / Removal:

  Buyer’s Premium: 10% on all purchases

1. Buyer’s Premium

A 10% Buyer’s Premium will be added to the final bid price of every lot, forming the total purchase amount owed by the buyer.

2. Registration & Bidding

All bidders must register through our online bidding platform and provide their full name, address, phone number, email address, and a valid credit card.

By registering, the bidder authorizes Wooley Auctioneers to charge their credit card for the purchase price, Buyer’s Premium, and any applicable surcharges.

All bids constitute a binding contract. If you are the high bidder, you agree to pay the full invoice and comply with all terms stated herein.

3. Payment

Accepted payment methods include:

• Visa, MasterCard, American Express, Discover

• Cash

• Cashier’s Check

• Wire Transfer

Credit card payments will incur a 3.5% surcharge.

For invoices exceeding $1,500, credit cards will NOT be accepted. Payment must be made via cash, cashier’s check, or wire transfer.

Personal checks are not accepted.

Payment must be completed at time of pickup/removal.
If someone else will be picking up items on your behalf, you must contact Auctioneer Brad Wooley at 501-940-3979 prior to removal to arrange payment.

4. Removal / Load-Out

All items must be removed during the following scheduled times:

• Wednesday, December 17 | 9:00 AM – 5:00 PM

• Thursday, December 18 | 9:00 AM – 12:00 Noon

No exceptions will be made.

Buyers are solely responsible for bringing all tools, equipment, labor, rigging, and transportation necessary to safely disconnect and remove purchased items.

All items are sold AS-IS, WHERE-IS, and nothing will be stored or held beyond the removal period.

Items remaining after the deadline will be considered abandoned, and no refunds will be issued.

5. Shipping

Wooley Auctioneers does not ship items from this auction.

Large or heavy items may require third-party rigging, freight, or professional removal services. Buyers are responsible for obtaining quotes and making all shipping or pickup arrangements.

Contact shipping providers immediately after the auction closes if needed.

6. Condition of Items / Inspection

All items are sold “AS IS, WHERE IS” without warranties or guarantees of any kind, whether expressed or implied. This includes—without limitation—warranties of merchantability and fitness for a particular purpose.

A Preview/Open House is available on Monday, December 15 from 11:00 AM – 1:00 PM, where bidders may personally inspect items to assess condition, age, usage, and compatibility.

Descriptions and photos are believed to be accurate, but neither seller nor auctioneer is responsible for errors, omissions, or misstatements.

7. Bidding & Internet Platform

This is an online-only auction conducted through an internet bidding platform. Wooley Auctioneers does not guarantee uninterrupted service, error-free operation, or bid transmission.

The auction may utilize a soft close: any bid placed within the last minute of a lot’s closing time may automatically extend that lot for approximately one additional minute.

The auctioneer reserves the right to:

• Add or remove lots

• Re-catalog or regroup items

• Modify the closing schedule

• Resolve any bidding disputes at their discretion

8. Winning Bidder Responsibilities

The winning bidder for each lot agrees to:

1. Pay the full invoice amount (bid price + Buyer’s Premium + any surcharges), and

2. Remove all purchased items within the posted load-out schedule.

Failure to pay or remove items by the deadline will result in forfeiture of the items without refund, and the bidder may be held liable for damages, fees, and associated costs.

9. Age & Legal Compliance

Bidders must be at least 18 years of age. By registering, bidders acknowledge they meet the age requirement.

Some items may involve local, state, or federal compliance regarding installation, removal, handling, or disposal. Buyers are fully responsible for compliance and associated costs.

10. Sales Tax & Licensing

Applicable Arkansas state and local sales tax will be collected unless a valid resale certificate is provided before bidding.

It is the buyer’s sole responsibility to manage all tax documentation and compliance.

11. Announcements & Addenda

Any announcements, written addenda, or notices made by Wooley Auctioneers prior to the close of bidding will take precedence over all printed or posted information.

Bidders are responsible for reviewing any updated terms or lot changes.

12. Jurisdiction & Venue

This auction and its terms are governed by the laws of the State of Arkansas.

All legal disputes must be filed in a court of competent jurisdiction in Pulaski County, Arkansas.

13. Refusal of Service & Buyer Default

The auctioneer reserves the right to refuse bidding privileges or service to anyone for any reason.

In the event of default (non-payment or failure to remove items), the buyer will be held liable for all losses, damages, fees, or costs incurred, and items may be resold at auction or by other means.

14. Severability

If any portion of these Terms & Conditions is determined to be void or unenforceable, the remaining provisions will remain in full force and effect.

15. Acceptance of Terms

By registering for and/or placing a bid in this auction, the bidder acknowledges that they have read, understand, and agree to all Terms & Conditions presented herein.
